§ 1 Scope of application
For the business relationship between Musical Arts Edition (MAE or publisher) and the Customer, the following General Terms and Conditions shall apply exclusively in the version valid at the time of the order.
§ 2 Conclusion of contract and withdrawal
The MAE undertakes to accept the order of the Customer according to the General Terms and Conditions. In case of spelling, printing and calculation errors on the website, the MAE is entitled to withdraw from the contract.
§ 3 Right of withdrawal of the customer
The customer is entitled to revoke his declaration of intent directed at the conclusion of the contract within two weeks after receipt of the goods by returning the goods to the publisher.
The timely dispatch of the goods shall be sufficient to meet the deadline.
The customer shall bear the costs of returning the goods, unless the delivered goods do not correspond to the ordered goods. (see § 6)
In the event of revocation, the publisher shall refund to the customer any purchase price already paid.
In the case of repayments abroad, any fees incurred for the transfer will be deducted.
In the event of significant deterioration or loss of the goods, the customer shall compensate the publisher for the corresponding reduction in value or loss in the event of revocation.
If the customer has already paid the purchase price, the publisher is entitled to deduct the reduction in value from the repayment amount.
The right of revocation is excluded in the following cases:
a) in the case of contracts for the delivery of goods that have been manufactured according to customer specifications within the meaning of Section 3 (II) No. 2 of the Distance Selling Act.
b) in the case of contracts for the delivery of bulk orders, such as choir sets, orchestral material and the like, since these are specially produced and are available from the publisher as viewing or loan material. (see Loan and Viewing Material)
§ 4 Delivery
Unless otherwise agreed, delivery shall be ex warehouse to the delivery address specified by the Customer. Delivery shall be made at the expense and risk of the Customer. The Publisher shall not insure the goods against damage in transit. The risk is transferred to the customer when the shipment leaves the publisher's warehouse. The publisher will not provide compensation for shipments that are lost or damaged in transit. In order to protect his interests, the customer or recipient must report the case of damage to the post office, railroad, parcel service or forwarding agent within the deadlines given by them.
§ 5 Subsequent deliveries
Information about the delivery period is not binding. There is no obligation on the part of the publisher to deliver or to adhere to the stated delivery deadlines.
§ 6 Returns
In the event of a return shipment, only prepaid packages can be accepted for logistical reasons. In case of an error on our part, the postage will be refunded.
§ 7 Due date and payment, default
The purchase price is due for payment immediately without any deduction before delivery of the goods, but at the latest upon receipt of the invoice. In the event of late payment or unjustified deductions, all expenses resulting from the dunning process will be charged; in addition, interest on arrears may be charged at a rate of 2% per annum above the discount rate of the Deutsche Bundesbank.
§ 8 Retention of title
The ownership of the delivery item remains with the MAE until receipt of all payments from the contract.
§ 9 Warranty for defects and liability
In the event of a defect in the purchased item for which Lothringer Verlag für Bühne und Musik is responsible, Lothringer Verlag für Bühne und Musik shall be entitled to choose between rectification of the defect or replacement delivery. If Lothringer Verlag für Bühne und Musik is not willing or able to remedy the defect/replace the delivery or if this is delayed beyond a reasonable period of time for reasons for which Lothringer Verlag für Bühne und Musik is responsible or if the remedy of the defect/replace delivery fails in any other way, the Customer shall be entitled to withdraw from the contract.
§ 10 Shipping costs
All prices do not include shipping costs, which are automatically calculated from the shopping cart when ordering online. For orders placed elsewhere with the publisher, the MAE for Stage and Music charges between € 5.00 and € 15.00 (depending on the size of the order).
Shipping costs include the cost of postage and packaging.
For private individuals, shipping costs are waived if the value of goods exceeds € 50.
§ 11 Data protection
The Customer has been informed in detail about the type, scope, location and purpose of the collection, processing and use of the personal data required for the execution of orders by the MAE (see "Security & Data Protection"). The Customer expressly agrees to this collection, processing and use of personal data.
§ 12 Applicable law and place of jurisdiction
German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
